Recently a barrister failed to spot that sources they had researched and relied upon in their legal argument were fake. When challenged that these cases were non-existent, the barrister was dismissive.
The judge took a different view:
- it was unreasonable to claim these fake cases were “minor citation errors”
- the barrister should have reported herself to the Bar Council
- the instructing solicitors should have reported themselves to the SRA
- the barrister would have been negligent if she had used AI without checking the output first
This is not the first time this has happened and probably won’t be the last. So, make sure you verify your AI output, implement appropriate policies for using AI, be aware of the ethics and disciplinary risks if you do not check AI output and train on how to use AI.
